This week, we have proudly supported Resolution’s Good Divorce Week. Their annual campaign promotes constructive, low-conflict separation processes, recognising the value of early access to legal advice and the importance of non-court dispute resolution options, particularly in cases involving children. 

As Resolution members, we are committed to the guiding principles of the Resolution Code of Practice for family proceedings. This includes principles such as: 

  • Avoiding the use of inflammatory language
  • Supporting and encouraging families to put the best interests of children first
  • Acting with honesty, integrity and objectivity
  • Helping our clients to consider the long-term emotional and financial impact of their decisions
  • Promoting communication and collaboration wherever possible
  • Using our experience and knowledge to guide clients through the options available to them. 

While divorce and separation can be quite challenging for families, it does not inherently have to be acrimonious. In most cases, it is possible to work towards a good divorce process and outcome. Instructing a Resolution member lawyer and other member professionals (e.g. mediators, financial advisers, therapists) who respect and adhere to the Code is a step towards achieving a more harmonious separation process. Minimising confrontation, working collaboratively together as well as exploring non-Court dispute resolution options can make the process less hostile and more constructive resulting in favourable settlements for the parties and their children.
