The Prosecution offered no evidence on a case of assaulting an emergency worker, following careful and detailed representations made by Elizabeth Garcia of the criminal team.
The representations were made prior to the trial in the Crown Court, following receipt of a Psychiatric Report confirming the defendant suffered with Generalised Anxiety Disorder. Together with the Report, representations were made on the basis that it was not in the public interest to prosecute.
The representations followed paragraph 4.14 in the Code for Crown Prosecutors and referred to each factor to be taken into consideration when deciding whether it is in the public interest to prosecute. The client was a young woman with no previous convictions, or any previous experience of the Police. The evidence was that no injury was suffered by the Officer, whereas the Defendant herself suffered a number of injuries following being restrained. The delay in the case arising from 2023 and the Defendant not having been in any trouble since that occasion, can be described as an isolated incident whereby she now had a young baby, is in work and supports her family.
The CPS agreed with the representations made and decided to offer no evidence, ensuring this young woman retains her good character.
