Share Article: Our Immigration Department’s case of KO is in the UK Supreme Court today! The issue: Should the impact on the child be taken into account by the Court or Tribunal when they are considering deporting the parent for misconduct

Re KO(Nigeria) (Appellant) v Secretary of State for the Home Department (Respondent) is being heard on the 17th and 19th April by the UK Supreme Court – the question they are being asked to answer is “When considering the public interest in deportation, should a Court or Tribunal take into account parental misconduct when assessing whether the effect of deportation on a child is “unduly harsh”?

More will follow as soon as judgment has been handed down.
